1. DMCA Notice
dupes.gg respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the dupes.gg platform (the "Service") that are reported to our designated copyright agent.
If you are a copyright owner or authorized to act on behalf of one, and you believe that your copyrighted work has been copied and made available on the Service in a way that constitutes copyright infringement, you may submit a notification pursuant to the DMCA by providing our designated copyright agent with the information described below.
2. Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice, you must provide a written notification to our designated copyright agent that includes the following information:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and that you want removed or access disabled, along with information reasonably sufficient to permit us to locate the material. This should include the URL(s) or direct links to the listing(s) on dupes.gg containing the allegedly infringing content.
- Your contact information: Your full legal name, mailing address, telephone number, and email address so that we can contact you regarding your notice.
- Good faith statement: A statement that you have a good faith belief that the use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law. For example: "I have a good faith belief that the use of the copyrighted material described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law."
- Accuracy and authority statement: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner. For example: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
- Signature: Your physical or electronic signature.
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure your claim is legitimate before filing a takedown notice.
3. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include:
- Identification of the removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (including the URL).
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which dupes.gg may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that we will restore the removed material within 10 to 14 business days unless the complainant files a court action against you seeking a restraining order or other legal remedy.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, dupes.gg has adopted a policy of terminating the accounts of users who are deemed to be repeat infringers in appropriate circumstances. dupes.gg may also, in its sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. This includes:
- First offense: The infringing listing will be removed and the user will receive a warning notice.
- Second offense: The infringing listing will be removed and the user's ability to create new listings may be suspended.
- Third offense: The user's account will be permanently terminated and all listings will be removed.
dupes.gg reserves the right to immediately terminate any account involved in egregious or willful infringement without following the graduated process above.
